Article 1: Scope of application
The general conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relationship between any user of the PRISM-SURFBOARDS.COM website (hereinafter referred to as a "User" or "You") and FRANCE OUEST COMPOSITES SARL, a company with a share capital of €3,000, headquartered at 19 Avenue Guillemet 44000 NANTES and registered with the Nantes Trade and Companies Registry under number RCS 790 586 903, VAT number FR44790586903, (hereinafter referred to as "PRISM SURFBOARDS") owner of the WWW.PRISM-SURFBOARDS.COM website. These general terms and conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written derogation. PRISM-SURFBOARDS.COM may from time to time modify some of the provisions of its general terms and conditions (of sale, of delivery and of guarantee), and it is therefore necessary that these be reread before each visit to the WWW.PRISM-SURFBOARDS.COM site (hereinafter referred to as the "Site"). We consider that by validating your order and/or your purchase, you accept without reserve our general conditions of sale after having read them. By accessing the Site, you agree to abide by the General Terms and Conditions and the Conditions of Use contained therein.
Article 2 - Contract - Contract conclusion stages.
After placing your order, We will send you an e-mail confirming the elements of your order.
This e-mail constitutes our acceptance of your order and thus forms the sales contract between Us and You.
Article 3 - Order validation
Please note that delivery of your order may be delayed by up to 24 hours, and that additional information may be requested or even required in order to validate your purchase. In order to avoid any delay, please enter the following information when placing your order: an e-mail address, and a telephone number (home or work) where you can be reached at any time during the day.
Article 4 - Prices
The sales prices indicated on the Site are in euros and include all taxes, but exclude delivery costs. Any delivery charges are payable by the User and are invoiced at the end of the order in addition to the products selected. We reserve the right to modify our prices at any time, but we undertake to apply the current prices indicated on the Site at the time of your order.
Article 5 - Product availability
The times mentioned for the preparation of your item(s) correspond to the processing times of your order (excluding shipping time) after validation of your order and after you have received an e-mail indicating that your order is being processed. Please note that we will honour your order while stocks last. In the event that, during the "processing" of your order, one of the products ordered is not available in the stocks shown on the site, we undertake to contact you by e-mail or by telephone within 30 days of the date of your order in order to inform you of this and to indicate how soon this product could, if necessary, be delivered to you.
Under no circumstances may a delay in delivery or in the processing of your order give rise to the cancellation of the order. Items and products benefiting from a special discount (discount, promotion, special offer, sale...) are subject to stock availability.
Under no circumstances may they be combined with any other special offer entitling you to a discount, with the exception of those or the credit code from which you are benefiting.
If an article benefiting from a special discount (discount, promotion, special offer, sale...) is no longer available, we undertake to offer you an article or product also benefiting from a special discount (discount, promotion, special offer, sale...) corresponding to the amount of your purchase in exchange, or to credit your account with a credit note for the amount of your order or to refund your order.
Article 6 - Product information
The photographs illustrating the products (presented on the site), do not enter into the contractual field and would not know how to give place to some engagement on behalf of PRISM SURFBOARDS on the data sheets and the descriptions of the products coming from our partners or suppliers. PRISM SURFBOARDS cannot be held responsible for the validity of their content.
Article 7 - Payment
Payment for your order may be made by credit card (CB, Visa or Mastercard) or by Paypal.
For payment by credit card, the debit is made on the day of your order, on condition that you have previously obtained authorization to debit your account from the relevant payment centers, failing which your order cannot be taken into account. In this case, online payment by credit card is made via the "CYBERPLUS PAIEMENT" security system, which encrypts your bank details as they are transmitted over the network.
In the event of cancellation of an order due to an error on your part (product error) involving a refund, the latter may be made by bank cheque or cancellation of your transaction via our bank or in the form of a credit note on another order (after deduction of costs incurred).
Article 8 - Warranties and after-sales service ("SAV")
For the first year, your product is covered by a manufacturer's parts and labor warranty. To take advantage of this, please contact PRISM-SURFBOARDS after-sales service directly. Whatever the problem with your item, you must enclose a copy of the invoice with the equipment. The warranty does not apply to the repair of damage resulting from an external cause (e.g. accident, shock), use that does not comply with the equipment's specifications, use of products that are harmful to the preservation of the board, commercial or collective use, or use of unsuitable accessories. The warranty does not cover transport costs.
Article 9 - Agreement on proof
The Customer acknowledges the admissibility as evidence of computer recordings, computer reports and listings and other electronic media, in particular in the context of any dispute arising from a breach of the present contract by one of the Parties.

Article 11 - Liability
PRISM SURFBOARDS shall not be held liable for non-performance of the contract in the event of force majeure, disruption or total or partial strike, particularly of postal services and means of transport or communications, flood, fire or war. PRISM-SURFBOARDS.COM shall not be held liable for any indirect loss, operating loss, loss of profit, loss of opportunity, damage or expense that may arise from the purchase of any product presented on the Site.
PRISM-SURFBOARDS.COM shall not be held liable for any consequences resulting from the misuse of products sold on its Site.
Hypertext links may lead to sites other than the Site. PRISM-SURFBOARDS.COM declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force. PRISM-SURFBOARDS.COM's liability shall in any event be limited to the amount of the order.
Article 12 - Right of withdrawal - Satisfied or your money back
The Buyer has a period of fourteen (14) days, from the date of delivery of the order, to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception of the cost of return, which is at his expense.
The product(s) must be returned in accordance with the conditions set out in the delivery and return policy of these GTCS.
The Vendor undertakes to reimburse the Purchaser for all sums paid. Reimbursement will be made to the credit card account debited at the time of the order, within a maximum of fourteen (14) days of the Buyer exercising his right of withdrawal, subject to compliance with the above-mentioned conditions.
Article 13 - Privacy
The information you provide is essential for the processing and dispatch of orders, and for the preparation of invoices and warranty contracts. Failure to provide this information will result in the cancellation of your order. By registering on the Site, you agree to provide us with true and accurate information about yourself. The communication of false information is contrary to the present general terms and conditions as well as to the conditions of use appearing on the Site.
In accordance with the French Data Protection Act, the processing of your personal data has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). PRISM-SURFBOARDS.COM is authorized to collect, process and use information concerning you. This data is processed electronically.
You have a permanent right of access and rectification of all data concerning you, in accordance with European texts and national laws in force (article 34 of the law of January 6, 1978).you can at any time make a request to PRISM-SURFBOARDS.COM to find out what information it has on you. You may modify this information at any time upon request.
PRISM SURFBOARDS is the sole owner of your personal information. Only PRISM-SURFBOARDS.COM and its contractual partners may send you information as part of specific, one-off promotional operations. These partners are specially chosen by PRISM-SURFBOARDS.COM and are recognized for the quality of their products and services.
Article 14 - Disputes
The present contract is subject to French law. Any dispute, regardless of the place of delivery, which may arise from the interpretation or execution of these General Conditions shall be submitted to the competent courts of the Nantes Court of Appeal.
In the event of a dispute with Alma, you may appeal to the AFEPAME consumer mediator.
Article 15 - Consumer advice
All reviews submitted by PRISM-SURFBOARDS.COM users are read and checked before being put online. Only reviews concerning products will be accepted and therefore visible on the site. Consumer reviews therefore only concern products.
